TERMS OF USE

LAMU web site is a property of DIPROMO S.L., domiciled in Ibiza (Spain)

The following Terms of Use (hereinafter called TOU) outline your obligations when using the LAMU website (wwwlamu.es). Please read these TOU carefully before browsing the LAMU website.


Whether you are registered as a LAMU user or simply visiting our site or browsing LAMU´s Content in any way, you become bound to these TOU as if read and agreed with no exceptions.


LAMU´s website trademark, logo, icon, products, commercial names or distinctive signs, pictures, videos and texts (hereinafter called The Content) are exclusive property of DIPROMO S.L. and therefore only DIPROMO S.L.  holds its exclusive rights of exploitation.


The unauthorized use The Content, as well as any damage caused to Intellectual and Industrial Property rights of DIPROMO S.L. will incur in legally established responsibilities.  The access, downloading or the use of any kind of the LAMU site Content does not, in any way, transfer any right, title or interest in the Content to you.


DIPROMO S.L. reserves the right to modify www.lamu.es site TOU, contents, presentation and trading conditions   without previous notification being the user´s sole and exclusive responsibility to acknowledge them at any time.

All third party links within the web Content have to be to www.lamu.es main page, being expressly prohibited “deep links”, “framing” and any other use of www.lamu.es Content in favor of unauthorized third parties.

Access to the site or/and the unauthorized use of The Content are the sole responsibility of the user. DIPROMO S.L. shall not be liable for any consequence or damage that may result from such access or prohibited use.

DIPROMO S.L. is not responsible for the security flaws that may occur or any damage caused to the user's computer system (hardware and software), or the files or documents stored therein as a result of: 

Presence of a virus on the user's computer
Malfunction of the user´s browser used to connect to The  Content
 Use of non-updated versions of the above mentioned browser by the user.

In any case, DIPROMO S.L. assumes no responsibility whatsoever for the content linked from www.lamu.es, nor guarantee the absence of viruses or other elements in it that can cause alterations in the computer system (hardware and software), documents or user files, including responsibility for any damages of any kind caused to the user or to any third party for this.

 In the event that any user/client or third party considers that the content or the services provided by the linked sites are illegal, violate constitutional values or principles, or injure property or rights of the user or a third party they kindly are requested to immediately notify DIPROMO S.L. via e-mail (info@lamu.es) that fact, especially if the links are:


Activities or contents that could be considered criminal under the Spanish criminal law.
Activities or contents that violate intellectual property.
Activities or contents that jeopardize public order, criminal investigation, public safety and national defense.


Activities or contents that jeopardize public health protection, respect for the dignity, the principle of non-discrimination, protection of health and children or any other value or constitutional principle.

Disputes

These TOU shall be governed by and construed in accordance with the Spanish law, especially the legislative Royal Legislative Decree1/2007 of 16 November, Law of Consumer Protection, Revised text of the General Law for the Protection of Consumers and Users and other complementary laws, without prejudice to any contrary overriding mandatory rule of the country of the consumer’s habitual residence.


In the event of a dispute the jurisdiction will be upon the courts of the place where the consumer has his/her domicile or residence according to the applicable law or, at customer’s choice in case of action started by the customer, upon the Spanish Court of Ibiza.
